About ONSCENE

ONSCENE Inc. was founded by Joseph Markham in 2014 and became an incorporated company in 2015. Operating out of Horseshoe Valley, Ontario, Canada, ONSCENE Inc. was designed and built to offer volunteer fire departments and its’ members an efficient way to communicate with each other. Utilizing the latest capabilities of smart phones and tablets (Android & iOS), our goal is to provide a tool that can be utilized for department and scene management. Backed by a management team with volunteer fire experience, senior computer programming, app development & design, customer service expertise and corporate leadership, ONSCENE promises to adapt, grow and evolve with our quickly growing user base.

Unfortunately ONSCENE is designed to be utilized by departments.

ONSCENE was built to use as little data as possible and is comparable to running any other app that utilizes GPS technology. Standard data rates from your mobile provider

7. Will ONSCENE always track my location? No. ONSCENE will only track your location once you have acknowledged you are responding to a call for service.

1. Introduction
1.1 We are committed to safeguarding the privacy of our mobile application (onscene) members; in this policy we explain how we will treat your personal information.

1.2 We will ask you to consent to our use of cookies in accordance with the terms of this policy when you first visit our mobile application. By using our mobile application and agreeing to this policy, you consent to our use of cookies in accordance with the terms of this policy.

2. Membership
2.1 Membership to this mobile application is only available to those who can form a legally binding contract. This site does not permit minors (under 18) to register. If any member fails to sign up with their correct particulars the account will be terminated immediately.

3. Collecting personal information
3.1 We may collect, store and use the following kinds of personal information:

(a) information about your computer and about your visits to and use of this mobile application (including your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and mobile application navigation paths;
(b) information that you provide to us when registering with our mobile application;
(c) information that you provide when completing your profile on our application including your department’s/company’s name, profile pictures/logo, date of incorporation/registration, license number, registration number, registration/license status, and other details of activities;
(d) information that you provide to us for the purpose of subscribing to our email notifications;
(e) information that you provide to us when using the services on our mobile application, or that is generated in the course of the use of those services;
(f) information that you post to our application for publication on the internet including your user name, your profile picture/logo and the content of your posts;
(g) information contained in or relating to any communications that you send to us or send through our mobile application (including the communication content and data associated with the communication);
(h) any other personal information that you choose to send to us; and
(i) provide details of other personal information collected.

3.2 Before you disclose to us the personal information of another person/department/company, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this policy.

4. Using your personal information
4.1 Personal information submitted to us through our mobile application will be used for the purposes specified in this policy or on the relevant pages of the mobile application.

4.2 We may use your personal information to:
(a) administer our mobile application and business;
(b) personalise our mobile application for you;
(c) enable your use of the services available on our mobile application;
(g) send you non-marketing commercial communications;
(h) send you email notifications that you have specifically requested;

(i) send you marketing communications relating to our business which we think may be of interest to you, by post or, where you have specifically agreed to this, by email or similar technology (you can inform us at any time if you no longer require marketing communications);
(k) provide third parties with statistical information about our users (but those third parties will not be able to identify any individual user from that information);
(l) deal with enquiries and complaints made by or about you relating to our mobile application;
(m) keep our mobile application secure and prevent fraud;
(n) verify compliance with the terms and conditions governing the use of our mobile application [(including monitoring private messages sent through our mobile application private messaging service)]; and]

4.4 We will not, without your express consent, supply your personal information to any third party for the purpose of their or any other third party's direct marketing except that of law enforcement agencies or as required under the law.

9. Third party mobile applications
9.1 We have no control over, and are not responsible for, the privacy policies and practices of third parties.

Terms and Conditions

1. Introduction
1.1 These terms and conditions shall govern your use of our mobile application.
1.2 By using our mobile application, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our mobile application.
1.3 If you register with our mobile application, submit any material to our mobile application or use any of our mobile application services, we will ask you to expressly agree to these terms and conditions.
1.4 You must be at least [18] years of age to use our mobile application; and by using our mobile application or agreeing to these terms and conditions, you warrant and represent to us that you are at least [18] years of age.

2. Definitions
Unless there is anything contrary in the subject or context, in this document:
2.1 “We / Our / Us” means Onscene Inc.,
2.2 “You” means visitors and members.
2.3 “Mobile application” means onscene.

2.4 “Services” means any service provided through mobile application those include but limited toshow location of incidents, positions/movements of fire fighters and their vehicles, channel of communication among fire fighters etc.

3. Acceptable Use
3.1 You must not:
(a) use our mobile application in place of Pager or other established means to know incident details or have instructions, it can only be used as a tool to assist fire fighters during operations;
(b) use our mobile application in any way or take any action that causes, or may cause, damage to the mobile application or impairment of the performance, availability or accessibility of the mobile application;
(c) use our mobile application in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
(d) use data collected from our mobile application for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).

3.2 You must ensure that all the information you supply to us through our mobile application, or in relation to our mobile application, is true, accurate, current, complete and non-misleading.

4. Registration and Accounts
4.1 To be eligible for an account on our mobile application, you must have a registered/licensed fire department.
4.2 You may use our mobile application free for the trial period of 45 days commence just after your registration.
4.3 You may opt for the membership of one, two, three, four or five years by making payment for such period in advance. If you subscribe for the membership for 05 years, you will get a free tablet from Onscence Inc. Payment may be made either through paypal, credit card, debit card or cheque. In order to make payment through cheque, you first have to send your cheque in the name of Onscence Inc., at our company’s address along with a written request for getting registered.
4.4 You may apply for renewal of membership before one week of its expiry date. We will notify you for the renewal of your membership before one month of its expiry.
4.5 You may register for an account with our mobile application by completing and submitting the account registration form on our mobile application, and clicking on the verification link in the email that the mobile application will send to you.

4.6 You must notify us in writing immediately if you become aware of any unauthorised use of your account.
4.7 You must not use any other department’s account to access the mobile application unless you have that department’s express permission to do so.

5. User IDs and Passwords
5.1 If you register for an account with our mobile application, we will provide you with a user ID and password.
5.2 You must keep your password confidential.
5.3 You must notify us in writing immediately if you become aware of any disclosure of your password.
5.4 You are responsible for any activity on our mobile application arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

6. Cancellation and Suspension of Account
6.1 We may:
(a) suspend your account;

(b) cancel your account; and/or at any time in our sole discretion without notice or explanation.
6.2 You may cancel your account on our mobile application by requesting us to do so.Membership fee will not be refunded for unexpired membership tenure.
7. Limited Warranties
7.1 We do not warrant or represent:
(a) the completeness or accuracy of the information or location of any incident or position of fire fighters and their movements on our
mobile application; (b) that the information or location on the mobile application is up to date (mapping/location may only be accurate as most up to date as per google maps and notto be relied upon).; or
(c) that the mobile application or any service on the mobile application will remain available.

7.2 We reserve the right to discontinue or alter any or all of our mobile application services, and to stop publishing our mobile application, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any mobile application services, or if we stop publishing the mobile application.
7.3 To the maximum extent permitted by applicable law, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our mobile application and the use of our mobile application.

8. Limitations and Exclusions of Liability
8.1 Nothing in these terms and conditions will:
(a) limit or exclude any liability for fraud or fraudulent misrepresentation;
(b) limit any liabilities in any way that is not permitted under applicable law; or
(c) exclude any liabilities that may not be excluded under applicable law.

8.2 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
8.3 We will not be liable to you in respect of any special, indirect or consequential loss, damage or injury.
8.4 Our mobile application may be used either through wifi or data connection. We will not be liable for any data charges that may be incurred from your service provider

9. Breaches of these Terms and Conditions
9.1 Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
(a) send you one or more formal warnings;

(b) temporarily suspend your access to our mobile application;
(c) permanently prohibit you from accessing our mobile application;
(d) commence legal action against you, whether for breach of contract or otherwise; and/or
(e) suspend or delete your account on our mobile application.

9.2 Where we suspend or prohibit or block your access to our mobile application or a part of our mobile application, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).

10. Variation
10.1 We may revise these terms and conditions from time to time.
10.2 The revised terms and conditions shall apply to the use of our mobile application from the date of publication of the revised terms and conditions on the mobile application, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. We will give you written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of our mobile application from the date that we give you such notice; if you do not agree to the revised terms and conditions, you must stop using our mobile application.

11. Updates
11.1. The Software which you use may automatically download and install updates from time to time from services. These updates are designed to improve, enhance and further develop theOnscene, enhanced functions and completely new versions. You agree to receive such updates (and permit Onscene to deliver these to you) as part of your use of Onscene.

12. Assignment
12.1 You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
12.2 You may not without our prior written consent assign, transfer your account or rights of use of account to any other company or department.

13. Severability
13.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
13.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

14. Entire Agreement
14.1 These terms and conditions, together with our privacy policy, shall constitute the entire agreement between you and us in relation to your use of our mobile application and shall supersede all previous agreements between you and us in relation to your use of our mobile application.
15. Law and Jurisdiction
15.1 These terms and conditions shall be governed by and construed in accordance with the laws of Canada.
15.2 Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Canada.
16. Statutory and Regulatory Disclosures

17. Indemnification
You agree to defend and indemnify onscene and its affiliates and any of its officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

(i) your breach of this Agreement;
(ii) your violation of any law or the rights of a third party; or
(iii) your use of this mobile application.
